Rental Terms

dansommer holiday homes are always subject to the following terms and conditions as part of the agreement between tenant and dansommer:

Introduction

Prior to the start of your holiday you will receive a service folder which contains specified directions on how to get to your holiday home and a detailed description of the house as well as where to collect the keys. You will also find a leaflet ”Information and useful tips for your holiday”, which we recommend you read before your holiday starts. The leaflet contains various information about the house and important instructions for the use of: sanitary facilities, technical installations and surroundings etc. Unfortunately dansommer cannot ensure that everyone enjoys a problem-free holiday and therefore the leaflet has information in case of theft, burglary, emergencies, pests, noise nuisance etc. Furthermore you will find symbols showing the differences in rules and regulations in Denmark, Norway and Sweden respectively.

1.Rental period

Normal arrival day is Saturday for holiday homes in Denmark (excl. the island of Bornholm where normal arrival day is Sunday). The rental period begins at 15:00 hrs on the day of arrival and runs until 10:00 hrs on the day of departure (arrival between 15:00 and 18:00 hrs).

 

For holiday homes in Norway the normal arrival day is Saturday and the rental period begins at 16:00 hrs on the day of arrival and runs until 10:00 hrs on the day of departure (arrival between 16:00 and 20:00 hrs).

 

For holiday homes in Sweden the normal arrival day is Saturday and the rental period begins at 16:00 hrs on the day of arrival and runs until 10:00 hrs on the day of departure (arrival between 16:00 and 18:00 hrs).

 

In Denmark all days of the week are accepted as arrival and departure days during the period before 02.07 and after 20.08, keeping in mind that you must book minimum one week. This only applies for houses without indoor swimming pool.

In Norway and Sweden all days of the week are accepted as arrival and departure days for the seasons C and D - however, only for a certain number of houses, and you must book minimum one week.

During Christmas and New Year (17.12.2005 to 07.01.2006) arrival and departure days are optional for all houses (except 24.12 and 31.12) – minimum booking of one week. However, if one day falls into the A-season you will automatically be charged the A-season rate for the whole week. The keys to the holiday homes are only handed over with proof of the original booking confirmation. The arrival and departure dates stated on the booking confirmation are always applicable.

 

In Central Europe the rental period for holiday homes begins on the day of arrival at 16:00 hrs and runs until 10:00 hrs on the day of departure, unless stated otherwise in the catalogue, price list or booking confirmation. Arrival should take place before 19:00 hrs.

 

In Southern Europe the rental period begins at 17:00 hrs on the day of arrival (in Croatia however it is at 14.00 hrs) and runs until 10:00 hrs on the day of departure, unless stated otherwise in the catalogue, price list and/or booking confirmation. Arrival should take place before 20:00 hrs.

Alternative or late arrival time must be notified in due time before arrival to the local dansommer office or to the key holder. dansommer cannot be held responsible if your late arrival makes it impossible for you to gain access to the holiday home.

In France, Italy, Croatia and Spain mainland the arrival day is generally Saturday.

In Greece and the Canary Islands the arrival day is optional. You must however always inform us of the date of arrival 3 weeks in advance.

2. The holiday home

2.1 House size and equipment/facilities

Each house is inspected and approved by dansommer. Apart from the items mentioned in the text of the catalogue, all dansommer holiday homes include: cold and hot water in the kitchen and bathroom, a coffee maker, garden furniture (minimum one table and chairs). The square metric size of the home is calculated using the outer base measurements.

2.2 Number of occupants

The number of occupants in a holiday home (adults, teenagers and children age 3-11 yrs.) must never exceed the number of persons stated in the house description (see the catalogue text). Children under the age of 3 are not included. If the number of tenants exceed the allowed, the owner or dansommer may refuse access for the extra persons without warning. If the tenants do not comply with this within 12 hours the owner or dansommer can cancel the tenancy immediately without further warning.

2.3 Tents and campers

It is forbidden to pitch tent or park a camper etc. on the holiday home ground or nearby. The owner or dansommer have the right to demand it removed immediately. If the tenants do not comply with this order, the owner or dansommer can cancel the booking immediately and without further warning.

2.4 Pets and allergies

In some houses pets are not allowed. However, the owner or dansommer cannot guarantee that there has not been dogs or cats in the house previously.

2.5 Barbecue

Many of the homes have a barbecue. The barbecue may need cleaning before use, as there is a possibility that it has not been used for some time. However, this does not exempt the tenant from cleaning the barbecue upon departure – see final cleaning item 10.

2.6 Nature ground

The idea of a nature ground is to let the vegetation grow wild, so these grounds may not always be suited for ball games etc.

2.7 Newly built houses

Please note, that the surroundings to a newly built house have not always had time to vegetate with grass, bushes etc.

2.8 Bed sizes

The normal bed size is 190-200 cm x 70-85 cm. The mattresses are often made of foam. Bunk beds do not always have a ladder or bed guard. The sun bed is often placed above a bed in order not to take up space.

2.9 Noise

The tenants, even in holiday areas, may sometimes be subject to noise from traffic or construction work etc. The owner or dansommer are not accountable for this kind of noise problems.

2.10 Hot water

The holiday homes normally have a hot water heater with a limited capacity, approx. 20-30 litres, which corresponds to one shower.

3. Rental price

The prices in the catalogue are in DKK (Danish kroner) per house per week. All prices on our web-site, www.dansommer.se are in SEK (Swedish kroner). In case of currency fluctuations dansommer reserves the right to alter the prices in accordance herewith.

3.1 Booking confirmations already made

If the currency should fluctuate more than 5% dansommer has the right to raise the price. The tenant must be informed immediately and is here after free to cancel his/her booking. This hereby discharges both parties of claim against the other.

3.2 Before booking confirmations are made

dansommer reserves the right to raise the price in case of a substantial currency fluctuation and is obligated to inform the tenant before the booking confirmation is made. The rental price covers the holiday home as a whole. Accessories and inventory are at the tenant’s disposal free of charge. The price includes consumption of water, unless otherwise stated. The seasons, as mentioned in the beginning of the catalogue and at the bottom of each page, are valid unless otherwise clearly stated. For houses without swimming pool the price is calculated per day, before 02.07 and after 20.08, minimum price for at least 7 days.

4. Prepayment of rent

4.1 For reservations made 42 days or more prior to arrival:

Upon booking the 1. payment is due, 25% of the total price. The payment must be registered by dansommer at the latest 10 days after the booking confirmation is dated. The 2. payment is due and must be registered by dansommer, at the latest, 30 days prior to arrival and is equivalent to the balance sum of 75%.

4.2 For reservations later than 42 days prior to arrival:

The total sum is due immediately.

If these terms of payment are not met, dansommer can cancel the reservation without further warning. dansommer sees the lack of payment as a violation of the conditions stipulated in the agreement, item 15. The date of payment equals the deadline. If possible, dansommer will advise the tenant of this cancellation in advance.

5. Cancellation insurance

All rental prices on the website is net prices and they do not include any kind of cancellation insurance.

6. Energy consumption, use of telephone and firewood

6.1 Energy consumption

Those houses where energy consumption is not included (see the symbols in the house description) and where there is no coinbox, you will recieve an energy statement together with the keys to the house. This is a statement with the electric meter reading taken by dansommer’s service employee before your arrival. The meter does not show decimals, only whole kWh – also the red numbers are whole figures. After your departure a dansommer employee will again read the meter and on the basis of this reading a settlement of your energy consumption will be made. With regards to the price of electricity: see ”Worth knowing” the item ”electricity and telephone”. All indoor swimming pools in dansommer houses are heated on arrival. Therefore, please expect additional energy consumption (electricity or oil) for heating up the swimming pool. The price varies with the seasons, water temperature and the size of the pool. Upon arrival the swimming pool has a temperature of approx. 24 degrees C.

6.2 Telephone

If there is a telephone at your disposal in the holiday home, the bill will be settled upon departure together with electricity.

6.3. Firewood

Firewood for the fireplace or wood burning stove is not included in the price. Firewood that may lie by the house is to be considered the owner’s private property and may only be used, when an arrangement has been made in advance with the owner. You are not allowed to use firewood collected on the beach or in the nature, because of possible salt content that can cause permanent damage to the fireplace or wood burning stove. Firewood can be purchased locally from smaller grocery shops or petrol stations.

7. Deposit

In accordance with the owners’ wishes, the conditions of the rental agreement state that a deposit must be paid before the keys are handed over to the tenant. The size of the deposit depends on the facilities of the house and amounts to the following in the holiday country’s currency (a larger deposit can be demanded):

 

- swimming pool DKK 2600,-

- whirlpool DKK 1100,-

- all other houses DKK 750,-

 

For school or youth groups dansommer reserves the right to demand a larger deposit than mentioned above. The deposit is payable in the currency of the country to dansommer’s service agent upon arrival or when the keys are collected. The deposit serves as an insurance for the owner in case of damage to the house or insufficient cleaning. The deposit is refundable at the latest 14 days after departure minus energy consumption and the use of telephone. If there should be damages or insufficient final cleaning this will be deducted including a handling charge before refund. Should the amount payable surpass the deposit, the difference will be charged to the tenant.

Holiday homes in Central and Southern Europe have an additional deposita/á conto (on account) for electricity etc., which is refundable upon departure (or approx. 4 weeks after) minus consumption, provided the house is clean and without damage on departure.

8. Bring these items along

Following items are not part of the inventory in the houses, so please bring: bed linen (i.e. sheets, duvet covers, pillowcases) towels, tablecloths, dishtowels and cleaning detergent. If there is a baby bed in the house (see the catalogue text), and you will be using it, you must also bring bed linen incl. pillow and duvet for this bed.

9. Rowing boat

If the owner of the house has left a rowing boat at the tenant’s disposal free of charge, the tenant is responsible for it’s use. Before each use of the boat, please check that there are 2 oars, 2 oarlocks and that a possible anchor and rope are in working order. Anyone using the boat must wear life jackets. Children under 16 years may only use the boat accompanied by an adult.

After using the boat the tenant must leave the boat secured and above high tide level. If an accident should occur using the boat, neither the owner nor dansommer can be held responsible.

10. Final cleaning

The tenant is obligated to leave the house clean and tidy on departure. Please make sure to clean the refrigerator, freezer, cooker, oven, barbecue and sanitary installations. Please leave the house in an order comparable to your own wishes. Additional costs with regard to final cleaning will be deducted from the tenant’s deposit. If the tenant has booked final cleaning, it does not exempt him/her from doing the dishes, emptying the fridge and tidying up the house and it’s surroundings before departure.

11. Damages

The tenant is obligated to treat the house and it’s surroundings with respect. The house must be departed in the same condition as it was upon arrival, apart from the usual wear and tear. The tenant is responsible for damages occurred to the house or inventory during the tenancy whether made by him/herself or others. Damages must be reported immediately without delay to dansommer. Complaints regarding damages during the tenancy will, as long as the claim is reported and accepted as happened during usual attentiveness, be made responsible within 2 weeks of departure, unless the tenant has acted deceitful. The owner/dansommer makes a ”tenancy report” check after each tenancy and before the next tenancy begins, in which shortages and damages to the house and/or it’s inventory, and possible insufficient cleaning or lack thereof are noted.

12. Shortages, claims and tenant’s responsibilities

The tenant’s holiday must not be spoiled by any missing items or defects to the house and it’s inventory. If complaints are noted, dansommer must immediately be contacted, so that the owner can be asked to correct the defect as soon as possible. With regard to houses with swimming pool or whirlpool dansommer will contact the owner or service agent for help and advice. The tenant is obligated to report missing items and defects to dansommer as soon as they are noted in order to minimize damages. If these are not reported until departure, the tenant has no claim or has a lesser claim of a refund or reduction in price. General rules with regard to the tenant’s obligation to act loyally and respectfully are as follows:

-Missing items and defects are to be reported immediately to dansommer, no less than 5 days after arrival. Address and telephone number for the local service office is in the house description as part of the travel documents.

-Please give the owner adequate time to correct claims.

-Contribute to minimizing damages and defects in order to keep the loss as small as possible for the owner and dansommer.

Early departure prior to the end of the tenancy without contacting dansommer’s local office is at the tenant’s own expense thus risking no compensation or reduction.

13. Technical installations

Many houses have a washing machine, dishwasher, microwave, video, TV, satellite dish, radio, freezer, dryer, sauna, sun bed, swimming pool, whirlpool, telephone, fax etc. As these items are free of charge, the tenant cannot make claims if e.g. brief and unforeseen disturbances, damages or power failures occur. The same also counts for plumbing and sanitary installations etc. In case of such defects the tenant should inform dansommer, so that we can ask the owner to arrange for repairs as soon as possible.

14. dansommer as provider

dansommer provides rental of holiday homes but do not own them. The responsibilities therefore lie solely with the house owner. If the tenancy cannot be completed, for reasons beyond dansommer’s influence e.g. a compulsory sale of the house, a breach of contract by the house owner etc., dansommer has the right to cancel the tenancy and refund to the tenant the payment already paid. However dansommer has both the right and obligation, if possible, to offer the tenant an equivalent but alternative holiday home in the same area and at the same price.

15. Cancellation / changes

15.1 Only a written cancellation is accepted and it is not valid until dansommer has received it.

15.2 The cost of cancellation:

a) From booking date up until 70 days prior to arrival – 10% of the total price (minimum EURO 65,-).

b) From 69 days to 42 days prior to arrival – 25% of the total price (min. EURO 65,-).

c) Less than 42 days prior to arrival – 100% of the total price.

If dansommer does not receive a written cancellation the total sum is due even if the holiday home is not used at all by the tenant. The fee is round up to whole amount in EURO.

15.3 The deadline for the days in question in item 14.2 is the night previous to arrival at midnight.

15.4 If the tenant is able to find a new tenant for the same days in question and at the same price, dansommer will accept a change of name on the agreement. This must be submitted to dansommer or the travel agency in a written form.

15.5 dansommer will acccept a change of the original booking up until 42 days prior to arrival (for an extra fee of EURO 40,-). Any changes made less than 42 days before arrival will be considered a cancellation and a new booking must be made (see above terms and conditions).

16. Court rules

 

Tenancy in the holiday home is subject to the local court’s and country’s legislation.

17. Unusual events

17.1 In the case of war, natural disasters, epidemics, closing of borders, traffic conditions, discontinuity of foreign exchange trade, strikes, lock-outs and other force majeure conditions which could not be foreseen when the booking was made, give both dansommer and the tenant the right to cancel the booking. However, neither the house owner nor dansommer can be held accountable for these events. In case of force majeure dansommer is entitled to charge coverage for costs in connection with the booking.

17.2 In case of insect plague on the holiday house and it’s surroundings, theft or other situations of this nature neither the house owner nor dansommer can be held responsible.

18. Other information

18.1 Although the tenant makes a special written agreement with dansommer, it does not automatically suspend dansommer’s other terms and conditions of rental.

18.2 The holiday homes are rented out in the order that they are reserved.

18.3 dansommer is not accountable for printing and photo errors.

18.4 All information in this catalogue is, to the best of our ability, passed on as correctly as possible.

18.5 The catalogue is valid for the period 02.01.2005 to 07.01.2006.

18.6 If a holiday home is rented on the basis of the existing catalogue for a period starting 07.01.2006 the terms and conditions of the new catalogue are valid. (Release in November 2005).

18.7 Any commercial use of this catalogue, totally or partially piracy, is prohibited according to existing legislation.

18.8 We recommend that you read the passages ”Practical Information” and ”About the holiday home” and the brochure ”Information and tips for your holiday” as part of the terms and conditions. The last mentioned brochure is enclosed in the service folder, which all tenants receive before their holiday starts.
